Well, Jack, I'm not DrB (unless you believe as peglam), but I am her better (lesser at times) half. I have one questions for you. Why in the world would a poster board cause you to google search or whatever you did a person and then use that persons issues against them? That is beyond me how you justify making it right with Kiasmomma and yet you never said you were sorry for doing the search to begin with and then using that against her. Do you understand what cyberbullying is all about? I do. I got a crash course Sat when I returned home and talked with Capt. Herrera. Can you explain to me what was your motive and what you were hoping to accomplish? D says to not talk or respond to certain people but when I saw you here, I just had to ask the questions. I could care less about Jackie and Work OUt. I just watch the boards now to see the soap opera unfold.
A lot of people post on boards and use the same username. I don't think that's wise unless you keep your personal details closely guarded. There are many Jack123's out there and none are me. I do post on OUtzone and sometimes other boards but not as Jack123.
When Kia posted her thoughts on AIDS victims I was very taken aback. Of course, I've confronted such opinions before but I had a hard time accepting that this view was coming from someone who was part of my community. A community that has already faced so much discrimination and hostility. So I googled Kiasmama. I googled her username. Nothing more. A username is not someone's identity nor would I have posted or discussed her personal identity should I have found as much. I wasn't interested in finding that info. I was simply curious to see what other boards she posted on. There was part of me that wondered about what Dacia had said and I wanted to see if Kiasmama was going to pop up on some crazy anti-gay site. It didn't but I thought what did come up was interesting.
Based on Kiasmama's other message boards, she struck me as someone who should understand compassion and struggle. So I brought it up to make a point and formulate an argument. I never once threatened her nor did I ever make reference to her identity. There is a huge difference there. Stalking would be going on those boards and harassing Kia. I wouldn't and didn't do that. Stalking would be attempting to gain her personal identity and expose it. I wouldn't and didn't do that. As for the point I was trying to make, I think it's clear in my subsequent posts.
Concerning harassment, I think calling someone's place of employment and attempting to interfere with their life could be considered harassment. I've seen a great deal of digging into Jackie Warner's life on this board that goes well beyond fun curiosity. Poking fun of someone, making snarky comments on a board is very different than overstepping the line into their life. That's it.
I'm very well versed on cyberbullying, the laws and lack thereof so I'd be happy to discuss it with Capt. Herrera. I'm also very familiar with other forms of bullying and hate crimes. I'm sure Capt. Herrera is a lovely person but the laws are ambiguous at best. I work with victims all the time and I know what the police can, can't do and all too often won't do. There is a reason the Lori Drew case is a Federal one. The local and State laws simply don't exist and it will be hard to indict her on Federal Fraud charges as well. Did she do someting horrible? Yes but she is being indicted on fraud not on bullying. So we fail to write laws that protect people and because of this mistake, we risk giving up our anonymity. There are some huge moral issues in this case but I'm not sure any can be addressed within the framework of law. I don't want to go off on the Lori Drew tangent but it's clear why we should exercise compassion and tolerance when dealing with real-life situations. I wasn't cruel to Kia. I pointed out the flaws in her arguments. I think her views are cruel and intolerant.
I'll leave this particular topic by reminding everyone what ignorance, close-mindedness and intolerance can lead to when it exists within a family, culture or community.
(I have to say again. I NEVER wanted to be soooooooo serious on this board. UGH!)
I will never forget David Ritcheson. Who is to blame? Everyone.
May his tortured soul rest in peace. May all those who have taken their own lives because of ignorant hate, find forgiveness and eternal rest.
Now please don't bring up Capt. Hererra again unless you're willing to get serious about real issues of hate and bullying. 2006 Texas assault incidentThe 2006 Texas assault incident refers to the beating, torture, and sexual assault of a Latino student, by two white youths during the early morning of April 22, 2006 in an unincorporated section of Harris County, Texas, United States. The details of the attack lead to publication of the story in various media outlets in and outside of the United States.[1][2] The victim of the assault, whose identity was not made public until months after the attack, committed suicide a year after the incident.[3]
The assaultThe incident occurred at a residence located north of the city of Houston, with a Spring, Texas address, at a party held at the Sons family home. Two Klein Collins High School students, David Henry Tuck and Keith Robert Turner, beat, tortured, and sodomized David Ritcheson, a 17-year old fellow Klein Collins student and former running back for the school American football team.[4][5]
Tuck and Turner, who were both under the influence of recreational drugs, said they were told that Ritcheson, also under the influence of drugs, tried to kiss a 12 year old white girl, Danielle Sons.[6] Sons' statement threw Tuck into a rage, and Tuck punched Ritcheson. The first punch was so powerful it broke Ritcheson's cheekbone and knocked him unconscious, stated Dr. Red Duke, the emergency physician who treated him.[7]
Tuck and Turner dragged Ritcheson outside, stripped him naked, burned him with cigarettes, and attempted to engrave a swastika into the Ritcheson's chest.[6] Tuck kicked Ritcheson with steel-toed boots and kicked a patio umbrella PVC pole up his rectum several inches while yelling racial slurs. After the sodomy ended, the perpetrators poured bleach on the victim's body to conceal the evidence of the crime. The attack lasted for over an hour. Ritcheson was left lying behind the house for more than 10 hours before he was found and an ambulance was called.[8] Ritcheson suffered from extensive injuries including a perforated bladder.[7] The night after the assault, Ritcheson's lungs failed, and the victim was placed on a ventilator. According to County prosecutor Mike Trent, the attackers may have poured bleach inside the pipe as high levels of toxins were found in the Ritcheson's organs.[8]
In December 2006, Tuck and Turner were both convicted of aggravated sexual assault. Tuck, who was described by prosecutors as a white supremacist,[9] was sentenced to life in prison,[9] and Turner was sentenced to 90 years.[10] Turner unsuccessfully appealed his conviction to the 14th Court of Appeals for the State of Texas. On March 20, 2008, the Court of Appeals issued its opinion affirming Turner's conviction. Both Tucker and Turner must serve at least 30 years before becoming eligible for parole.[6]
AftermathAfter being contacted by the Anti-Defamation League (ADL) and agreeing to make his name public, Ritcheson went to Washington, D.C., and on April 17, 2007, testified to the United States House of Representatives Judiciary Subcommittee about passing more stringent hate crime laws.[11][3][5]
After a lengthy recovery, which included a three-month stint in the hospital and more than 30 surgeries,[6] Ritcheson refused professional counseling and never spoke about his experiences to his friends.[12] During an interview with The Houston Chronicle, Richeson stated:
"I shouldn't care what people think or say. It's just the fact that everyone knows I'm the kid. It was bigger than Houston. It was bigger than Texas. It was bigger than America. Everybody in the world knew what had happened and everybody knew the details of it."
DeathOn the morning of July 1, 2007, Ritcheson committed suicide by jumping from the deck of the MS Ecstasy, a cruise ship bound for the Mexican resort island of Cozumel.[3][13] The Ritcheson family's attorney, Carlos Leon, confirmed his death.[3]
